TRAINING ENROLMENT AGREEMENT
Between:
The Skarblend® Academy Ltd. of 115B Clipstone Road West, Mansfield, Nottinghamshire
NG19 0BT (“the Academy”)
and
The Student whose details are completed at the time of signing (“the Student”).
- Purpose and Effect
This Agreement sets out the legally binding terms under which the Academy provides
professional scar-camouflage and paramedical-tattooing training.
By signing, the Student acknowledges that they have read, understood, and agree to all
provisions herein. - Definitions
“Course” means the programme of study selected by the Student.
“Digital Materials” means all manuals, videos, PDFs, online modules, or other digital content
released by the Academy.
“In-Person Training” means any practical tuition, assessment, or shadowing day delivered by
the Academy.
“Assessment” means the final practical and/or written evaluation required for certification.
“Intellectual Property” means all proprietary teaching materials, content, methods, and
branding belonging to the Academy. - Course Provision
The Course comprises blended delivery, including online theory, Digital Materials, and In-Person
Training and assessment.
All content and schedules are at the discretion of the Academy, which may amend content or
dates to maintain quality or accreditation standards.
- Consultation and Enrolment
Prior to enrolment, the Student is invited to a complimentary video consultation outlining
structure, outcomes, and expectations.
The Student’s place is secured only upon signature of this Agreement and receipt of the first
payment. - Fees and Payments
5.1 Fees are confirmed in writing before enrolment.
5.2 Payment options:
(a) Full payment in advance; or
(b) Four instalments by Stripe Direct Debit.
5.3 For instalments, automatic collection dates are set out in the payment schedule supplied at
enrolment.
5.4 Digital Materials and course access are released only after the first cleared payment.
5.5 All payments are contractual and form part of a binding training contract.
5.6 No Student may attend Assessment, receive certification, or apply for insurance or licensing
until the full balance is paid.
5.7 Failure to maintain payments may result in suspension of access, withdrawal of training
dates, and withholding of certification until arrears are cleared. - Refunds and Cancellations
6.1 The Student understands that course fees secure access to protected intellectual property
and reserved training resources.
6.2 Once Digital Materials have been issued, no refunds will be given under any
circumstances.
6.3 Attendance at any In-Person Training renders all payments made to that date
non-refundable.
6.4 If the Student cancels after signing but before Digital Materials are released, the Academy may, at its discretion, refund fees minus reasonable administrative costs.
6.5 No refunds are available once any element of the Course has commenced or Digital Materials have been accessed.
6.6 The Student expressly agrees that the statutory right to cancel under Regulation 29 and 37 of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 is waived once access to Digital Materials is provided.
6.7 Chargebacks: The Student irrevocably authorises all payments and waives any right to initiate, request, or authorise a chargeback via Stripe, card issuer, or bank once access to Digital Materials or training has been granted. Any attempted chargeback constitutes breach of contract, and the Academy reserves the right to recover sums, administrative fees, and legal costs. - Digital Access and Intellectual Property Rights
7.1 All course content and Intellectual Property remain the exclusive property of the Academy.
7.2 Access is granted solely for the Student’s personal study during enrolment and under a revocable, non-transferable licence.
7.3 The Student shall not:
(a) save, copy, screenshot, photograph, or record content except for private study;
(b) distribute, share, upload, sell, or transmit materials to any other person;
(c) use the materials to teach, demonstrate, or create derivative work; or
(d) permit any third party to access the content.
7.4 Unauthorised copying or distribution constitutes infringement under the Copyright, Designs and Patents Act 1988 and may result in termination of training, revocation of certification, civil proceedings, and claims for damages.
7.5 The Student shall not deliver scar-camouflage or paramedical-tattooing education privately or through another academy for two (2) years following completion without written consent of the Academy. - Rescheduling and Illness
8.1 If the Student is unable to attend due to illness, notice must be given as soon as practicable by email or telephone.
8.2 The Academy will reschedule to the next suitable date within six (6) months at no extracost. This is a deferral, not a refund.
8.3 If the Student cancels again or fails to attend the rescheduled date, the session and allrelated payments are forfeited.
8.4 If the trainer or venue is unavailable due to illness or unforeseen circumstances, the Academy will provide reasonable notice and offer the earliest alternative date. This shall satisfy the Academy’s obligation to deliver training. - Assessment and Certification
9.1 Completion of all online modules, case studies, and full attendance at required sessions are mandatory for certification.
9.2 Certification will only be issued once the Student has passed assessment and paid all fees in full.
9.3 Until certified, the Student must not represent themselves as qualified, insured, or licensed to practise scar-camouflage or paramedical-tattooing. - Health, Safety and Conduct
10.1 The Student must comply with all infection-control and safety protocols.
10.2 The Academy reserves the right to remove any person whose behaviour endangers others or breaches standards, without refund.
10.3 Students participate in live-model procedures at their own risk. - Limitation of Liability
11.1 Nothing in this Agreement limits liability for death or personal injury caused by negligence.
11.2 Subject thereto, the Academy’s total liability for any claim arising from the Course shall not exceed the total fees paid.
11.3 The Academy shall not be liable for indirect or consequential loss including loss of income, opportunity, or reputation. - Data Protection and Confidentiality
12.1 The Academy complies with the Data Protection Act 2018 and UK GDPR.
12.2 Personal data will be used solely for training administration, certification, compliance, and communication.
12.3 The Academy will not share data with third parties except where legally required or for accreditation purposes. - Force Majeure
The Academy shall not be liable for delay or failure to perform obligations where such failure results from events beyond its reasonable control, including illness, venue closure, extreme weather, or national emergencies. Training will be rescheduled once practicable.
- Entire Agreement and Variation
14.1 This Agreement constitutes the entire understanding between the parties and supersedes any prior representations or communications.
14.2 No amendment shall be valid unless made in writing and signed by both parties. - Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of England and Wales, and the parties submit to the exclusive jurisdiction of the courts of England and Wales. - Acknowledgement and Acceptance
By signing below, the Student confirms that they:
1. Have read, understood, and accept all terms of this Agreement;
2. Acknowledge that course payments are non-refundable once Digital Materials are released or In-Person Training has begun;
3. Irrevocably waive any right to initiate or authorise chargebacks;
4. Understand that certification and insurance eligibility require full payment and successful assessment; and
5. Agree to comply fully with all Intellectual Property and confidentiality obligations.
